Common questions

How much do PSLA’s services cost?

Although each client is assessed a fee that reflects the amount of work needed to deliver the right product for their individual circumstances, the typical fee is around $2,000. This includes the in-depth review of one’s case, all legal research, drafting the initial motion and accompanying Memorandum of Law, and drafting the reply brief to the government’s opposition.

Does PSLA submit my 2255 motion to the court or am I responsible for filing?

Because these motions are pro se filings, they must be signed by the defendant and mailed by him or her to the court through the prison legal mail system. We use a printer service to deliver three copies of each document to the client via the US Post Office. We also email digital copies (as a PDF) of the documents to the client’s representative.

How will PSLA communicate with me?

We have found that email communications work best in most circumstances. PSLA can email a client directly using the CORRLINCS system or through an intermediary. If necessary, a phone call with PSLA staff can be arranged but we suggest scheduling the call 24-hours in advance.

Does PSLA use CORRLINCS?

Yes, we do. Just add info@proselegaladvocates.com to an inmate’s CORRLINCS account. We usually accept the invitiation in 24-hours.

I have a lot of legal documents, how can I get them to PSLA for review?

We typically deal only with digital copies of documents. But paper documents, such as hearing transcripts, letters from lawyers, etc., can either be mailed to PSLA at the address below. Upon receipt, we will scan the documents to make digital copies. Any mailed documents must be accompanied with a request to preserve the documents, in which case PSLA will return them to the defendant or defendant’s representative. Otherwise documents will not be returned.

How long will it take for PSLA to complete my 2255 motion?

From the time we agree to assist a defendant, until the final motion is delivered, usually takes between 8 – 10 weeks, though each case is unique and a number of issues can effect our timeline. PSLA will provide a detailed timeline after we have analyzed your case, identified the legal issues involved, understand the complexities of the arguments, and determined whether additional resources need to be gathered and analyzed. This time frame can be accellerated under certain circumstances but we typically can not promoise to deliver a product in less than four-weeks.

My direct appeal is still pending, can I file a 2255 motion?

No. A defendant cannot file for habeas corpus relief until all of their appellate rights have been exhausted and “finality” has attached.
